Since we are passing innocuous order, we do not feel it necessary to issue notice to the respondent before passing the order.

Learned counsel for the petitioner submits that the concerned Judicial Officer i.e. 4th Jt. CJJD & JMFC, Nanded is not dealing with the matter pending before him bearing PWDVA Application No. 52/2024 diligently. According to him, the petitioner resides at Sangli and his counsel is also ready to cross-examine the respondent/wife as she has filed her evidence affidavit. Moreover, he had also submitted an application for closing the evidence of respondent/wife as she was reluctant to lead evidence in the said matter. Considering the same, we had called report from the concerned Judge and

(2) 920 Cri.WP-1650.2025.odt pursuant to that, the concerned Judge had undertaken to decide the application of the petitioner for closing the evidence of respondent/wife.

However, today the learned counsel for the petitioner submits that the said application has been decided by the concerned Judge and the same is rejected. He further added that the respondent was present on the day of passing of the said rejection order and the counsel for the petitioner was also ready to cross-examine her on the same day, but the learned Judge again adjourned the matter.

Considering the fact that the matter is now fixed for evidence and that the petitioner is attending that proceeding from Sangli, we deem it appropriate to direct the concerned Judge to decide the matter expeditiously. In view of the same, the writ petition stands disposed of with direction to the learned 4th Joint Civil Judge (Junior Division) and Judicial Magistrate (First Class) at Nanded to decided PWDVA Application No.52/2024 as expeditiously as possible and preferably with six months from the date of communication of this order.
