None for the petitioner. Though the learned counsel Mr. Jaiswal was appearing on behalf of the petitioner, however, on 05.01.2026 he made submission that petitioner wanted to argue the matter personally. Today the learned APP produced on record communication dated 15.02.2026 along with the letter dated 14.02.2026. The said communication is taken on record and marked 'X' for the purpose of identification and on going through the said communication, it appears that now the list of inmates who

2 10.Crl.WP.1655.25.odt are eligible for open prison till 31.12.2025 is prepared and the name of present petitioner is included in the said list at serial No.194. The learned APP further submits that as per the letter dated 14.02.2026 the date of selection of the inmates to be transferred to open prison is sought and it is likely to be finalized within one month as instructed orally.

Be that as it may, the name of petitioner is now included in the list and in due course he will be shifted to open prison and his claim for shifting him to open prison will be decided in due course. As such, the purpose of this petition appears to be served and hence, the petition stands disposed of.
