The State Of Maharashtra v. The State Election Commission And Others
2026:BHC-AUG:21097-DB 1 980 wp 1748-25
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 980 CRIMINAL WRIT PETITION NO. 1748 OF 2025 THE STATE OF MAHARASHTRA
VERSUS
THE STATE ELECTION COMMISSION AND OTHERS ...
Mr. P. S. Patil, APP for the Petitioner Mr. Sharma Alok Madangopal, Advocate for Respondent Nos.2 & 3 ....
CORAM : SANDIPKUMAR C. MORE AND ABASAHEB D. SHINDE, JJ.
DATED : 07/05/2026 P. C. :
1.
Heard learned APP and Mr Alok Sharma learned counsel appearing for respondent Nos.2 & 3. By this writ petition, the petitioner has put forth the following prayer. "B.
By issuing appropriate direction like in the nature, the respondent authorities be order and directed to supply the CCTV footage of both No.268 Dharmapuri for the period of 19.11.2024 from 7.00 pm to 20.11.2024 to 10.00 of both No.268 Dharmapuri to the investigating agency without any instant delete and for that purpose issue necessary order."
2.
Learned APP, inviting attention of this Court to the communication dated 05/03/2025 issued by the Deputy District Election Officer, Beed, submits that the said authority is not able to
2 980 wp 1748-25 provide the CCTV footage in view of Rule 93 of the Conduct of Election Rules, unless a direction to that effect is issued by the competent Court. He further submits that the said CCTV footage is necessary for the purpose of investigation in connection with Crime No.326 of 2024 registered with Parali (Rural) Police Station. 3.
We find that since the Investigating Officer requires the said CCTV footage for proper investigation, there is no impediment in directing the concerned Deputy District Election Officer, Beed, to provide the CCTV footage as prayed for. We, therefore, find that the writ petition deserves to be allowed in terms of prayer clause-B and accordingly disposed of.
