Pursuant to order dated 20.01.2026, we have interacted with the contesting parties and the minor children in the chamber. However, the petitioner has already filed appropriate application in the Family Court, Aurangabad, for declaring herself as guardian of the minor children and also sought custody of the minors.

In this background, the learned counsel for the petitioner, on instructions, seeks permission to withdraw the present petition for pursuing the matter filed by the petitioner in the Family Court, Aurangabad.

In view of the same, the petition stands disposed of as withdrawn. We make it clear that, we have not observed anything on merit of the matter and we, therefore, direct the concerned learned Family Judge to decide the application of the petitioner before her as per its own merits.
