Heard the learned Advocates for the respective parties and the learned APP at length.

During the course of hearing, it was submitted that the appellants were not present on the spot. According to the learned Advocate for the appellants, accused No.1 was released on bail and he left Harsul Jail, Aurangabad, which is 3 to 4 kms. away from the spot of incident. He further submits that the tower locations of mobile of the accused persons show their presence at different locations. He has khs/Dec.2025/758

- 2 - further submitted that the Investigating Officer has not seized the CCTV footage in order to throw light on the presence of accused persons on the spot.

In that view of the matter, the Investigating Officer concerned is directed to file a detailed additional affidavit throwing light on the aforesaid issues.
