Needless to say that by the present appeal, the appellant accused seeks for renewal of his request of bail in connection with Crime No.299 of 2023 registered on 07.08.2023 with Selu Police Station, District Parbhani for the offences punishable under sections 302,143, 147, 148, 149 of the Indian Penal Code and section 3(1)(5) of the Schedule Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

On face of record, it appears that in earlier round of litigation, the present appellant accused had filed Criminal Appeal No. 971 of 2024. On 9th December, 2024, this Court (Coram: N. B. Suryawanshi, J.) passed an order and declined to grant bail to the present appellant. However, liberty was granted to the appellant for renewal of prayer for

930apeal978-25 bail, if the trial does not conclude within one year therefrom. Therefore, it was obligatory on the part of the trial Court to conclude the trial within period of one year, however, the Roznama placed on record shows that the trial has been commenced and only two witnesses are examined till date.

The learned Sessions Judge, Parbhani to submit report about status and stage of the trial by the next date. 5.
