This is an application for suspension of sentence passed by the J.M.F.C., Ponda, who imposed a sentence of 11 months and directed the Applicant to pay compensation of Rs.12,16,000/- and in default to undergo further imprisonment of 11 months. The conviction was sustained in a complaint under Section 138 of the Negotiable Instruments Act.

With a Criminal Appeal bearing No.367/2023, the Applicant deposited an amount of Rs.2,43,000/- being 20% of the compensation 5th May, 2025

903 CRMA 41-2025 amount. The appeal was ultimately dismissed on 27.01.2025 and the Applicant was directed to surrender before the concerned Magistrate by 07.02.2025. In the meanwhile, the Applicant has filed Criminal Revision Application and sought suspension of his sentence. 3.

The Applicant is ready to deposit an amount of Rs.2,50,000/- by 08.05.2025. In the event of the amount being tendered in the Registry of this Court, the same to be accepted. 4.

Considering these facts, the sentence imposed on the Applicant shall stand suspended on the Applicant furnishing a PR Bond of Rs.20,000/- with one surety in the like amount before the J.M.F.C., Ponda within one week from today.
