By the present Petition, the Petitioner is seeking following substantive relief :

"(b) Quash and set aside the order dated 16-09-2025 (restricting defence witnesses) and the orders dated 2511-2025 (rejecting defence applications including Exh.81, Exh.83, Exh.84 and Exh.85, and closing the defence evidence), together with all consequential directions pushing the matter to final arguments, as being without jurisdiction, barred by Section 362 of the Code of Criminal Procedure, and violative of the principles of natural justice and the fundamental right to a fair trial under Article 21 of the Constitution of India;" Talwalkar

Mr. Sameer Tendulkar, learned Advocate for the Petitioner states that during the pendency of the present Petition, the Petitioner has been acquitted in Case No. 5500018/SW/2015 by the Metropolitan Magistrate, 55th Court, Vile Parle, Mumbai. 3.

In view of the above, he states that the challenge in the Petition has been rendered infructuous.

In view of the statement made by the learned Advocate for the Petitioner, this Petition is dismissed as infructuous.
