By the present Petition, the Petitioner is seeking following substantive relief :

"That this Honorable Court may be pleased, by issuance of an appropriate Writ and/or Direction, to quash and set aside the Summons issued and the Complaint in Case No. 547 of 2025 by the Learnt Judicial Magistrate (First Class), 39th Court, Vile Parle, Mumbai, against the Petitioners, along with all subsequent proceedings and orders emanating therefrom or connected thereto, against the Petitioner(s), upon such terms and conditions as this Honorable Court deems appropriate under the circumstances of the case.;"

Ms. Pallavi Dabholkar, learned APP for the State submits that the order impugned, is an order issuing process, Talwalkar

12.WP27.2026.doc which is a revisable order. She therefore, submits that the Petitioner is required to be relegated to the revisional remedy. 3.

Faced with the said objection, Ms. Asha Bhuta, learned Advocate for the Petitioner sought a pass over. After some time, at her request the Petition was taken up. Ms. Asha Bhuta, on instructions from the Petitioner craves leave to withdraw the present Petition with liberty to file a Criminal Revision Application before the Sessions Court. She submits that the impugned order is dated 14th February, 2025, as such the Petitioner would have to file an Application seeking condonation of delay. She requests that the Application for condonation for delay be directed to be considered liberally. Ms. Pallavi Dabholkar, learned APP for the State does not object to the request made by Ms. Asha Bhuta. 4.

In view of the above, leave granted to withdraw the present Petition with liberty to file Criminal Revision Application before the Sessions Court having jurisdiction. 5.

Writ Petition No. 27 of 2026 is disposed of.. (ASHWIN D. BHOBE, J.) Talwalkar
