DATE:
12th JANUARY 2026 P.C.:
Stating that without consent of the petitioner who is the complainant in C. R. No. 424 of 2021, many accused persons were deleted in the charge-sheet, the learned counsel for the petitioner states that the investigation in this case is required to be transferred to the respondent no. 2 with further direction for a departmental inquiry against the respondent no. 3. 2.
However, after arguing for some time, the learned counsel for the petitioner seeks permission to withdraw this writ petition with liberty to the petitioner to avail of a statutory remedy as available to the petitioner in law.
3.
Without reflecting on merits of the matter, Writ Petition No. 43 of 2026 is dismissed as withdrawn with liberty as prayed for on behalf of the petitioner. All contentions are left open. [GAUTAM A. ANKHAD, J.] [CHIEF JUSTICE]
