On 23.04.2026, this Court, after hearing both the Counsels for the Petitioners and Respondent No.3 and the learned Additional Public Prosecutor adjourned the matter to today only to accommodate learned Senior Advocate, Mr Sudin Usgaonkar appearing for the Petitioners. It was clarified that the oral arguments were concluded. Today, an application is tendered on behalf of the Petitioners. The application seeks to place on record certain documents.
2. Heard Ms Snehlata Sahani, Advocate on behalf of the Petitioners. She submits that the aforesaid documents may be considered by this Court and appropriate orders be passed.
3. Learned Counsel for Respondent No.3, Mr Kohli, has opposed the application, inter alia, contending that the documents sought to be relied upon by the Petitioners have already been considered during the course of submissions and by way of the pleadings before this Court. He further submits that these documents are not germane for adjudication of the issue that falls for consideration before this Court.
4. Learned Public Prosecutor, Mr Bhobe, has also vehemently opposed the production of the documents sought to be produced by the Petitioners vide the application. He contends that what is sought to be brought on record are basically pleadings, which are part of arbitration proceedings pending between the parties inter se. He further invites the attention of this Court to the dates of the rejoinder affidavits, which are sought to be produced by way of this application. He submits that the dates of these rejoinder affidavits is 17.04.2026 and hence he concludes by submitting that these documents have not been discovered during the preparation of the present Petition as sought to be pleaded in para 13 of the application, but they are recent documents, which in his submission are not germane to the case at hand.
5. Be that as it may, the application is taken on record.
6. Since the arguments are concluded, the matter is reserved for
orders.
