This Petition is circulated in view of the ground mentioned in the praecipe dated 16.01.2026.

On 14.01.2026, the following order was made : "1.

Heard Mr. Pradyumna Agrawal, learned Advocate for the Petitioner. He states that after filing of the present Petition, the Petitioner passed away. He, therefore, craves leave to substitute the deceased with his widow by name Shelly Naveen Sharma.

Mr. Tanveer Khan, learned A.P.P. for the State/Respondent does not object to the proposed substitute.

In view of the same, amendment to be carried out forthwith.

Issue notice to the Respondent. Mr. Khan, learned A.P.P. appears and waives service on behalf of the State/Respondent. Mr. Khan seeks time to file reply dealing with the contentions raised by the Petitioner. He requests for two weeks time.

Reply be filed within two weeks for today with an advance copy to the learned Advocate for the Petitioner.

6.

At the request of Mr. Khan, learned A.P.P.,list the Matter on 30th January, 2026."

Today, by the praecipe, Advocate for the Petitioner on instructions from the Petitioner craves leave to withdraw the present Petition as the Petitioner intends to avail remedy by approaching the learned Trial Court. Mr. Sukanta Karmakar, learned APP for the State does not object to the request made by Mr. Pradyumna Agrawal, learned Advocate for the Petitioner for the withdrawal of this Petition. In view of the same leave granted to withdraw the Petition.

Writ Petition No. 72 of 2026 is dismissed as withdrawn.
