This Petition was circulated on the ground of urgency as mentioned in the praecipe dated 12th January, 2026. 2.

Mr. Advait Tamhankar, learned Advocate for the Petitioner states that by inadvertence, there is no compliance of the decision of this Court in the case of P v/s. A & Ors.1. He 1 Suit No. 41 of 2021.

501.WP115.2026.doc therefore, seeks leave to withdraw the present Petition with liberty to comply with the requirement of the said decision and file a fresh Petition on the same cause of action as mentioned the present Petition. In addition, he seeks leave to join the complainant as party Respondent to the Petition.

Ms. Pallavi Dabholkar, learned APP for the State does not object to the request made by Mr. Advait Tamhankar, learned Advocate for the Petitioner and states that leave can be granted. 4.

In view of the above, leave granted to withdraw the Petition with the liberty to file a fresh Petition by complying with the law laid down in the case of P v/s. A & Ors.(supra) with liberty to join the Complainant as party Respondent in the Petition. 5.

Writ Petition No. 115 of 2026 is disposed of with liberty as above.
