Heard the learned Counsel for the parties.

The Petitioners-accused are seeking the transfer of Special Session Case No.1129 of 2025, then pending on the file of Special Judge, MCOCA 1st Court, Pune (Mr. V.R. Kachare) to the Special Judge, ARUN RAMCHANDRA SANKPAL MCOCA 2nd Court (Mr. S.R. Salunkhe).

The petitioners had moved an application for transfer of said Special Case No. 1129 of 2025, before the learned Sessions Judge. Petitioners had prayed for transfer of the Special case along with the Bail Applications.

By an order dated 16th December 2025, the said Application came to be rejected, as at that point of time, the 1st Special Court, MCOCA has ARS 1/2
22-WP-123-2026.DOC started functioning and another learned Sessions Judge (Mr. S.S. Kanthale) was presiding over the Special Court. 5.
The learned Counsel for the Petitioners submits that, in the intervening period, there is again a change in the assignment and Mr. S.S. Kanthale, the leaned Special Judge, has now been appointed as a Special Judge to preside over the Commercial Court, Pune. 6.
Attention of the Court is invited to an order dated 13th January 2026 passed by the learned Sessions Judge in Criminal MA No. 807 of 2025, wherein the said fact is recorded.

In view of the aforesaid development in the intervening period, the learned Counsel submits that now there is only Special Court, presided over by Mr. S.R. Salunkhe.

In the aforesaid view of the matter, the prayer for transfer of Special Session Case No.1129 of 2025, wherein the Bail Application of the accused are stated to be pending to the Special Court presided over by Mr. S.R. Salunkhe appears justifiable.

The learned Sessions Judge, Pune, is, therefore, requested to transfer the Special Case No.1129 of 2025, along with the pending Applications therein, to the Special Court MCOCA presided over by Mr. S.R. Salunkhe.

Petition disposed.
