Learned counsel for the Petitioner submitted that the Petitioner had already filed an Application for discharge under Section 239 of Cr.P.C.. It was rejected by the Additional Chief Metropolitan Magistrate, 9th Court, Bandra, Mumbai vide order dated 15.9.2023. He seeks permission to withdraw this Petition with liberty to challenge the said order through appropriate proceedings in accordance with law.
