Heard Mr. Vaibhav Gargade, learned Advocate for the Petitioner and Mr. Sukanta Karmakar, learned A.P.P. for the State/Respondent.

By the present Petition, the Petitioner has sought for the following substantive relief :- "a. That this Hon'ble High Court may be pleased to issue writ of mandamus or certiorari or writ in the like nature, thereby quash and set aside the impugned FIR bearing No. 136 of 2025 lodged under Sections 69, 351(2) and 352 of Bhartiya Nyaya Sanhita, 2023 at Arnala Police station (Exh. -"A" of the Petition)."

Mr. Sukanta Karmakar, learned A.P.P. for the

Gitalaxmi 921-WP-134-2026.doc State/Respondent submits that during pendency of the present Petition, charge-sheet has been filed.

Mr. Vaibhav Gargade, learned Advocate for the Petitioner on instructions from the Petitioner, states that in view of filing of the charge-sheet, the Petitioner craves leave to withdraw this Petition with liberty to file an Application for discharge before the Trial Court at the appropriate stage.

Mr. Sukanta Karmakar, learned A.P.P. for the State/Respondent does not object for grant of the request made by the Petitioner.

In the event, if any such Application is filed by the Petitioner before the learned Trial Court for his discharge, the same be considered on its own merits and in accordance with law. 7.

In view of the above, leave to withdraw the present Petition is granted. Criminal Writ Petition No. 134 of 2026 is disposed of as withdrawn with liberty as prayed.
