This Petition filed under Article 226 of the Constitution of India and 528 of the BNSS is preferred against the FIR No. 0187 dated 22.04.2025 registered against the Petitioners U/s. 498A, 504, 323, and 406 of the Indian Penal Code, 1860 at Kurla Police Station, Mumabai and the chargesheet bearing No. PW-2059 of 2025 arising out of the said FIR.

Petitioner is present along with Mr. Ashwin Hawelikar, learned Advocate appearing for the Petitioner.

Respondent No. 2 is present along with Mr. Nilesh Sahu, learned Advocate appearing for the Respondent No. 2. 4.

Mr. Hawelikar and Mr. Sahu, jointly submit that the matrimonial dispute between the Petitioner and Respondent No. 2 is amicably resolved and finally settled. He submits that in terms of the settlement the Petitioner and the Respondent No. 2 have decided to separate from each other. They therefore submit that the criminal proceedings initiated by the Respondent No. 2 be quashed. 5.

Mr. Sahu, learned Advocate appearing for the Respondent and Mr. Hawelikar, learned Advocate appearing for the Petitioner states that the Affidavit dated 26th December, 2025 affirmed by the Respondent No. 2 before the Notary Sujata J. Patil, District Thane, is placed on record as Exhibit - E on page no. 60 to 64 of the Petition paper book. Same is marked as 'X' for identification. 6.

The Respondent No. 2 (Ms. Namita Abhishek Jambhale)states that the Affidavit (X) is filed out of her own free will and without any force from any person. She submits that the contents of the said

Affidavit are as per her say. She submits that the matrimonial dispute being resolved between her and the Petitioner No. 1(Husband) she has no objection for quashing the FIR and the chargesheet. 7.

The Petitioner (Abhishek Vijaykumar Jambhale) states that he and the Respondent No. 2 have amicably resolved their matrimonial dispute and they have decided to part ways.

Ms. Dabholkar, learned APP appearing for the State, submits that in view of the Affidavit (X) no purpose would be served in continuing with the criminal proceedings and that the FIR can be quashed.

Considering the factual situation, the nature of dispute, the amicable resolution of the dispute as stated by the Respondent No. 2 in the Affidavit (X) and her no objection for quashing of the criminal proceedings commenced on the basis of a complaint, this petition can be allowed. Writ Petition is allowed in terms of prayer clause (a). Consequently, the FIR bearing No. 0187 dated 22nd April, 2025 and the chargesheet bearing No. PW - 2059 of 2025 are quashed.

Writ Petition No. 200 of 2026 is allowed and disposed of. There shall be no orders as to costs.
