Issue notice to the Respondents, returnable on 3rd March, 2025. The learned APP waives service of notice on behalf of Respondent No.1, State.

We have perused the contents of the First Information Report (FIR). The medico legal certificate, indicates the nature of the injuries suffered by the Complainant. There are six injuries and all seem to have been caused by the use of hard and blunt weapons. 3.
The allegation is that a stick was used by the Accused which caused five abrasions and one contusion. All the injuries have been
narrated to be simple injuries. The parties are closely related to each other from the maternal side. The Civil litigation has culminated in carving out shares of the property holders and the Complainant has approached this Court in Second Appeal No. 182 of 2021. The orders dated 2nd February, 2024 and 19th April, 2024 on Interim Application No. 3954 of 2023, would indicate that the Accused are in possession of their respective shares and the Complainant is restrained from changing the said possession.

A compilation of 16 pages is placed on record to suggest that it is a Memorandum of Understanding dated 28th December, 2024 between Accused No. 1 and the Complainant. The photostat copy of the said compilation is taken on record and marked as 'X-1' for identification.

In view of the above, we direct the learned Judge of the Trial Court to adjourn the proceedings in R.C.C. No. 23 of 2024, until the returnable date in this matter.

A copy of the Petition paper-book for issuance of Court notice to Respondent No.2, shall be supplied, on or before 27th January, 2025, failing which, the ad-interim order would stand vacated without
reference to the Court, on 28th January, 2025. 7.
Office objections, if any, to be removed, on or before 6th February, 2025, failing which, the Petition would stand dismissed without reference to the Court, on 7th February, 2025. (RAJESH S. PATIL, J.) (RAVINDRA V. GHUGE, J.)
