On 29.01.2026, the following order was made by this Court :- "1.

This Petition was called out at 4:55 pm. Neither the Petitioner nor the Advocate for the Petitioner are present when the Petition is called out.

Perusal of the Application indicates that the Petitioner is aggrieved by the Order dated 18th June, 2025 passed by the Special Judge under the POCSO Act, Thane, by which the Application filed by the Respondent No. 2 for seeking permission to renew the passport for a period of 10 years is granted. In view of the absence of the Petitioner/Advocate for the Petitioner and by way of an opportunity for the Petitioner/Advocate for the Petitioner to appear, list this matter on 5th February, 2026 under the caption 'For Dismissal'."

When this Petition was called out today, neither the Petitioner nor the Advocate for the Petitioner are present in the Court, either physically or through Video Conferencing mode. 3.

Mr. Prasanna Malshe, learned A.P.P. for the State/Respondent submits that the Petitioner apparently is not interested in the proceeding with the matter, which is evident from absence of the Petitioner, as also the Advocate for the Petitioner on the last date of hearing and today also. He submits that the Petition is notified on the Daily Board under the caption "For Dismissal". He therefore insists for dismissal of this Petition.

In view of absence of the Petitioner as also the Advocate for the Petitioner, I have no other option but to accept the submission of Mr. Prasanna Malshe, learned A.P.P. for the State/Respondent 5.

In the result, Criminal Writ Petition No. 336 of 2026 is dismissed for non-prosecution.
