Based on this statement, learned Counsel for the Petitioner does not press the petition but seeks permission to withdraw this petition with a liberty to adopt an appropriate proceeding challenging the framing of charge. Permission is granted. The petition is allowed to be withdrawn with the liberty as prayed for.
