This Writ Petition is for quashing of the FIR registered vide C.R. No.1346/2024 at Santacruz Police Station, under Section 185 of the Motor Vehicles Act, 1988 and under Sections 125(a), 281 of the Bharatiya Nyaya Sanhita, 2023 ("BNS Act"). The FIR is lodged by Respondent No.2 on 26/11/2024. He was a driver on a vehicle - Ranger Rover belonging to one Udai Singh. On 26/11/2024 at 12.40 am he was driving the car at Santacruz (west) and was taking a u-turn. At that time, a jeep came from the opposite direction and collided with the informant's car because of which there was a dent in the car. The Informant went to Cooper Hospital with his brother, but he had not suffered any major injury. On this basis FIR was lodged. 2.
Now the matter is settled between the parties. The
55-cri-wp-522-2025.doc Respondent No.2 has filed his affidavit. He has stated that the owner of the vehicle has paid Rs.2,50,000/- for the repairs of the jeep. The Petitioner had paid that amount to Respondent No.2 and thus he has paid adequate compensation. The Respondent No.2 has further stated that he has no objection for quashing of the FIR. 3.
No injury was caused to the informant. The owner of the car was adequately compensated. The informant has no objection for quashing of the FIR. Therefore, we are inclined to allow this Petition with the following order :
ORDER
(i) The FIR registered vide C.R. No.1346/2024 at Santacruz Police Station, and all consequential proceedings arising out of the said FIR, are quashed and set aside.
(ii) Petition is disposed of.
