This Writ Petition is for quashing of the FIR registered vide C.R. No.668/2024 at Vishnu Nagar Police Station, Dombivali, under Sections 498-A, 406, 323, 504, 506 of the Indian Penal Code. FIR is lodged on 14/06/2024 by Respondent No.2. In the FIR, she has stated that she got married with the Petitioner on 12/02/2016. When they had gone to Thailand, she had to spend Rs.3 Lakhs. The Petitioner took away her stridhan and other valuable articles. The Petitioner kept her passport with himself. She came to know that the Petitioner was not employed. The Respondent No.2 had to spend for household expenses. She got fed up and went to reside with her mother from 2/10/2016. On 25/10/2016, the Petitioner visited the Respondent
57-cri-wp-651-2025.doc No.2. Even then there was quarrel and he caused injury to her little finger. Based on these allegations, the FIR was lodged. 2.
Now the matter is settled between the parties. The Respondent No.2 has filed an affidavit of consent. There is a reference to execution of a Deed of Settlement. She has stated that the disputes are settled. She has received her articles as per Deed of Settlement dated 25/11/2024. In paragraph 4, she has specifically stated that she was giving her consent for quashing of the FIR. The Respondent No.2 is present in the Court. She is identified by her learned Counsel. She reiterated the contents of the affidavit and stated before the Court that she has no objection for quashing of the proceedings. 3.
The dispute between the parties is purely personal in nature. In view of the settlement, continuation of the proceedings will not serve any purpose. Hence, we are inclined to allow the Petition and pass the following order :
ORDER
(i) The FIR registered vide C.R. No.668/2024 at Vishnu Nagar Police Station, Dombivali, and all consequential proceedings arising out of the said FIR, are quashed and set aside. (ii) Petition is disposed of.
