1) Petitioners i.e. husband and mother in law of Respondent No.2, accused in C.C. No. 2900170/PW/2023, pending on the file of learned 29th Judicial Magistrate First Class, Sewree, Mumbai, arising out of CR No.265 of 2023, dated 31st August 2023, registered with Wadala T.T. Police Station, Mumbai, under Sections 377, 498-A read with 34 of Indian Penal Code (I.P.C.), are seeking quashing of the said case, with the consent of Respondent No.2, the informant.

Osk 30-Wp-675-2025.doc 2) Mr. Gandhi, learned Advocate for Respondent No.2 submitted that, the Respondent No.2 has already filed on record an Affidavit dated 27 th June 2025, duly affirmed before a Notary Public. It is stated therein that, due to the intervention of well-wishers and respective Advocates, all the disputes between the parties have been resolved and Consent Terms dated 20th November 2024 are executed. That, the Petitioner No.1 and Respondent No.2 have jointly filed a Petition bearing Petition No. 3645 of 2024 before the Family Court at Bandra, Mumbai, to facilitate dissolution of marriage by consent on the basis of the said Consent Terms. That, in the light of the amicable Consent Terms, the Respondent No.2 wishes to withdraw the present case. In para No.8 of the said Affidavit, the Respondent No.
2 has given her consent for quashing the said crime against the Petitioners. 2.1) Respondent No.2 is personally present in the Court and through her Advocate reiterates the contents of her Affidavit dated 27th June 2025 and her 'no objection' for quashing of the crime in-question. 3) In view of the above, Petition is allowed in terms of prayer clause (a).
