P.C.:- 1) Husband; father-in-law and mother-in-law of the Respondent No.2 have filed this Petition under Article 226 of the Constitution of India, for quashing of R. C. C. No.5253/2024, pending on the file of the Judicial Magistrate First Class, (Court No.8), Thane, arising out of C. R. No. 317 of 2024, dated 24th May 2024, registered with Navghar Police Station, MiraBhayandar, Vasai-Virar Police Commissionerate, under Sections 498-A, 504, 506 of the Indian Penal Court, with the consent of the Respondent No.2, the informant.

DDR 39. WP 762-25.doc 2) Mr. Bhadel, learned Advocate for the Respondent No.2 tendered across the bar her Affidavit dated 20th March 2025, duly affirmed before a Notary Public. It is stated therein that, the Petitioner No.1 and Respondent No.2 have filed the Consent Terms dated 9th December 2024, in Petition No.A-1607 of 2024, pending on the file of the Family Court at Bandra, Mumbai. Paragraph No.4 of her Affidavit reads as under :- "4.
I say that, as mutually agreed between myself and the Petitioner No.1 subject to terms and conditions of the Consent Terms dated 9/12/2024, I have no objection if the present Writ Petition is allowed as prayed for and all the proceedings arising out of C.R. No.317/2024 are quashed and set aside." 2.1) Respondent No.2 is personally present in the Court and through her Advocate reiterates the contents of her Affidavit dated 20th March 2025 and her 'No Objection' for quashing of the crime in question. 3) Learned Advocate appearing for the Petitioners tendered across the Bar their Affidavit dated 4th August 2025, thereby giving an undertaking to this Court that, the Petitioner No.1, so also other Petitioners will comply with all the terms and conditions mentioned in the Consent Terms dated 9th December 2024. The said Affidavit-cum-undertaking is taken on record. 4) In view thereof, the Petition is allowed in terms of prayer clause (b).
