There is a challenge to the externment Order and it's confirmation. My attention is invited to the observations made in paragraph 19 of the Order dated 19.01.2024 passed by this Court (Coram : N. J. Jamadar, J.) in Cri. W. P. No. 2805 of 2023. According to him, the offences which are under investigation cannot be considered while supporting externment Order. 3.
