Apparently, the learned Advocate for the Petitioner, appointed through the Legal Aid, has not taken any efforts in this matter. It is the learned Addl.PP who is assisting us.

The learned Addl.PP informs us that in this matter, the charges are yet to be framed, though the case was committed to the Sessions Court at Kalyan in 2023 and numbered as Sessions Case No. 320 of 2023 (wrongly mentioned as 297 of 2023 by the Accused, who has tendered a handwritten Application from Jail.) 1/2

In view of the above, we direct the learned Trial Court to take effective steps for framing the charges, in Sessions Case No. 320 of 2023, if there is no other legal impediment.

Insofar as the request for an out-of-turn hearing is concerned, we record that all litigants are equal in the eyes of the law. No special circumstances have been made out. Hence, the learned Trial Court shall deal with the said case in queue, depending upon the pendency of such matters. 5.
