Ms. P. P. Bhosale, learned APP for the Respondent -State, raises an objection to the maintainability of the present Petition, on the ground that the impugned Order would be a revisable Order against which a Revision Application before the Sessions Court would be maintainable.

Faced with the said objection, Mr. Harshad Sathe, learned Advocate for the Petitioner craves leave to withdraw the present Petition with liberty to file Criminal Revision Application before

the Sessions Court.

Mr. Harshad Sathe submits that the Petitioner was bonafidely pursuing this Petition before this Court, as such the request for a liberal approach being adopted by the Sessions Court on the Application for condonation of delay which the Petitioner would file along with the proposed Criminal Revision Application. 4.

Request made by Mr. Harshad Sathe is not objected to by Ms. P. Bhosale, learned APP for the Respondent-State. 5.

In view of the above, leave granted to withdraw the present Petition with liberty to file Criminal Revision Application against the Order impugned in the present Petition before the Sessions Court having jurisdiction.

If such Criminal Revision Application along with an Application seeking condonation of delay is filed before the Sessions Court within a period of three weeks from today, then, the Petitioner shall be entitled to exclusion of the time spent in this Petition in terms of Section 14 of the Limitation Act, 1963.

Criminal Writ Petition No. 911 of 2025 is disposed of as withdrawn.
