1) Ms. Bajoria, learned APP states that the charge-sheet is already filed in the crime which is subject matter of this Petition as well as the counter crime. Mr.Ganesh Kekan, API through Ms. Bajoria, the learned APP states that both the crimes arise out of one and the same incident. Both the cases are pending before the Court of learned Judicial Magistrate First Class, Vasai.

2) Considering the allegations in the FIR, the questions of fact and law raised in this Petition are required to be decided after hearing the merits of the case.
