1) By this Petition received through jail, the Petitioner is seeking benefit in his sentence for remission, as per the G.R. dated 3rd June 2017, issued by the Government of Maharashtra, on the occasion of 125 birth Anniversary of Dr. Babasaheb Ambedkar.

2) Heard Mr. Mishra, learned appointed Advocate by the Legal Aid Committee and Mr. Satpute, learned APP for Respondent, State. Perused the record.

3) Record indicates that, by Judgment and Order dated 3rd May 2023, the Petitioner has been convicted under Section 376 of the Indian Penal Code and Sections 6 and 8 of the POCSO Act, by the learned Special 1/2

dtg 51-Wp-1097-2025.doc Judge under the POCSO Act, Greater Mumbai.

4) The co-ordinate Bench at Nagpur in the case of Sonu alias Ashwin S/o Vitthal Meshram Vs. State of Maharashtra & Anr., (Criminal WP No. 865 of 2023), in its Judgment & Order dated 1st August 2024, has held that, a convict who has been convicted after the cutoff date i.e. 14th April 2016, are not entitled to get special remission, as per the said G.R. dated 3rd June 2017.

5) In view of the clear enunciation of the said issue by the coordinate Bench, we find no substance in the Petition and is accordingly disposed off.
