By the present Writ Petition, the challenge is to the legality and validity of the order dated 23rd December 2024, passed by the learned 4th Judicial Magistrate, First Class, Vadgaon Maval, Pune, below Exhibit1 in RCC No.28 of 2017. By the said order, process has been issued against accused Smt. Shital Tejvani, Vinay Archana and Smt. Sandhya Suryvanshi for the offences punishable under Sections 420, 464, 467, 468, 471 read with Section 34 of the Indian Penal Code, 1860 ("IPC"). 2.

The only challenge to the order dated 23rd December 2024, is that said Smt. Sandhya Suryawanshi has passed away on 12th May 2021 and thereafter process has been issued against her by the impugned order dated 23rd December 2024.

However, Mr. S. B. Desai, learned Counsel appears for the Original Complainant Shri. Subhash Yashwant Khalade and states that the fact that the accused Smt. Sandhya Suryavanshi had passed away will be informed to the learned trial Court by filing appropriate Application before the learned trial Court. The learned trial Court shall pass order on such application in accordance with law. 4.

In view of the above statement made by Mr. S. B. Desai, learned Counsel appearing for the Original Complainant, learned Counsel appearing for the Petitioner seeks withdrawal of the Writ Petition. 5.

Accordingly, the Writ Petition is allowed to be withdrawn and disposed of as such.
