At the outset, learned A.P.P raises a preliminary objection. She states that the petitioner has filed an application i.e. Criminal Application No.11/2025 in this Court for quashing of FIR i.e. C.R. No. 47/2024 registered with the Tokwade Police Station, Thane. She states that by this petition, the petitioner is challenging the letter sent by the Investigating Officer to the respondent No. 2 herein, pursuant to the aforesaid C. R. She submits that therefore, the petitioner ought to have challenged SQ Pathan 1/2

12-WP-1267-2025.doc the said letter by filing an appropriate application in Criminal Application No.11/2025.

In view of the preliminary objection raised by the learned A.P.P, learned counsel for the petitioner seeks leave to withdraw the petition with liberty to file an appropriate application in Criminal Application No.11/2025. Petition is accordingly disposed of as withdrawn with liberty as sprayed.

Needless to state, that all contentions of all parties are kept open.
