By this petition, the petitioner seeks transfer of investigation of C.R. No.275 of 2021 registered with the Shil Daighar Police Station, Thane City to D.C.B. C.I.D. or any other police station. Pending the hearing and final disposal of the aforesaid petition, a direction is sought to the respondent No.1, not to proceed with the 'B' Summary Report.

Learned APP on instructions states that the police have filed a 'B' Summary Report before the Court of the learned Magistrate, 1/3

Thane. She submits that in view of the same, it is now open for the petitioner to adopt appropriate proceeding before the said Court. 3.

In view of the grievance made by the learned counsel for the petitioner that he has not been informed about what has happened to his complaint i.e. C.R. No.275 of 2021, learned APP informs that the police will inform the petitioner of the same, within one week from today. Statement accepted.

In view of the aforesaid statement made by the learned APP, learned counsel for the petitioner does not press this petition and seeks leave to withdraw the same, with liberty to pursue the remedy as available to him, before the appropriate Court/Forum. 5.

Petition is accordingly disposed of as withdrawn with liberty as prayed.

We make it clear, that we have not gone into the merits of the petitioner's complaint/FIR or the 'B' Summary Report and as such keep all contentions of all parties open.
