By this Petition, the Petitioner seeks a direction to implead Nilesh Govind Khalde, Nivedita Sandeep Khursude, Nileema Sanjeev Bhosale, Kunal Khalde, Rahul Khalde and Sonam Kunal Khalde in C.R.No.90 of 2016.

Learned APP vehemently opposed the Petition. She submits that the Petitioner has come belatedly after almost 9 years from the date of registration of the FIR and after more than 4 years from the filing of the chargesheet. She states that the chargesheet is filed in the said case on 4th November 2019 and it is only in 2025, the Gaikwad RD 1/2
15-wp-1430-2025.doc aforesaid Petition has been filed. She states that it is open for the Petitioner to take appropriate steps before the trial Court, in accordance with law, in the event, a case is so made out against the said persons, during the trial.

In view of the aforesaid, learned counsel for the Petitioner seeks leave to withdraw the Petition with liberty to take appropriate steps before the trial Court during the course of trial. 4.
The Petition is accordingly disposed off as withdrawn with liberty as prayed for.

We make it clear that we have not gone into the merits of the Petition and as such, all contentions of all parties are kept open. 6.
Needless to state, that if an Application for addition of other accused is made before the trial Court, the trial Court to decide the said Application on its own merits, in accordance with law, uninfluenced by the withdrawal of this Petition.
