The challenge in these Writ Petitions is to the Order dated 2nd January 2025 passed by the learned Additional Sessions Judge, Sessions Court, Borivali Division, Dindoshi, Goregaon, Mumbai in Miscellaneous Application (Exhibit-17) in Criminal Appeal No.44 of 2021 ("impugned Order").

By the impugned Order the said Miscellaneous Application (Exhibit-17) has been rejected. The prayer in the said Exhibit-17 Application is seeking remand of the DV Case No.32/DV/2018 which
939-WP-1506-2025 And Sr No 940.doc was decided by the learned Metropolitan Magistrate, 66th Court, Andheri, Mumbai on 18th February 2020.

However, learned Counsel appearing for the Respondent-wife, states that the Criminal Appeal No.16 of 2021 filed by the Respondentwife and Criminal Appeal No.44 of 2021 filed by the Petitioner-husband have been finally disposed of by the Judgment and Order dated 5th May 2025 passed by the learned Additional Sessions Judge, Sessions Court, Borivali Division, Dindoshi, Goregaon, Mumbai, by modifying the Judgment and Order of the learned Metropolitan Magistrate, 66th Court, Andheri, Mumbai passed in the DV Case bearing CC No.32/DV/2018 on 18th February 2020.

Thus, as the Order dated 18th February 2020 passed by the learned Metropolitan Magistrate has been merged into the Order dated 5th May 2025 passed by the learned Additional Sessions Judge in said Criminal Appeal No.16 of 2021 and Criminal Appeal No.44 of 2021, there is no question of remand and thus nothing survives in the Writ Petitions.

Accordingly, Writ Petitions are disposed of as they have become infructuous.

However, it is clarified that all contentions which are raised in the Writ Petitions by both the parties are expressly kept open. [MADHAV J. JAMDAR, J.]
