P.C.:- 1) Petitioners i.e. husband, father-in-law and mother-in-law of Respondent No.2, have filed this Petition for quashing of C.R. No.0171 of 2024 dated 2nd March, 2024, registered with Kandiwali (W), Police Station, Mumbai, under Sections 498(A), 377, 406, 323, 506 and 504 read with 34 of the Indian Penal Code and Sections 3 and 4 of Dowry Prohibition Act with the consent of Respondent No.2, the informant. 1/2
ssm 2 40-wp1511.2025.doc 2) Learned Advocate for the Petitioners on instructions submitted that, till date the police have not filed charge-sheet. The said statement is accepted.
3) Mr. Naqvi, learned Advocate appearing for Respondent No.2 tendered across the bar an Affidavit dated 27th March, 2025 of Respondent No.2, duly affirmed before a Notary Public. It is stated therein that, Petitioner No.1 and Respondent No.2 have arrived at settlement and decided to dissolve their marriage by mutual consent. Accordingly, the Consent Terms are filed before the Mediator on 27th May, 2024. In paragraph No.13, the Respondent No.2 has given her consent to quash the present crime.
3.1) Respondent No.2 is personally present in the Court and through her Advocate reiterates the contents of her Affidavit dated 27th March, 2025 and her 'No Objection' for quashing of the crime in question. 4) In view of the above, Petition is allowed in terms of prayer clause (I).
