In this Petition, prayer is made for quashing of the C.C. No.459/PW/2023 pending before the Judicial Magistrate First Class, 40th Court, Girgaum u/s 324, 323, 504, 506 r/w 34 of the Indian Penal Code, which arises out of C.R.No.8/2023 dated 08/01/2023 registered at Girgaum Police Station, Mumbai. There is a cross FIR in respect of the same incident i.e. C.R. No.484/2022 dated 02/12/2022 at the same Girgaum Police Station. That FIR is lodged by the Petitioner herein u/s 326, 324, 323, 504 r/w 34 of the Indian Penal Code. We are informed by Digitally signed by MANUSHREE NESARIKAR Date:

Considering the nature of the fight which had taken place, which is the subject matter of both these FIRs, both the learned counsel on the instructions of their respective clients stated before the Court that the parties are willing to explore possibility of settlement through mediation.

Considering this stand, both the contesting parties are directed to appear before the Mediation Centre of this Court either personally or through their representatives on 17/04/2025 at 11.00 a.m. The officer-in-charge of the Mediation Centre shall appoint a suitable mediator from their panel to make an attempt to bring about the settlement between the parties. To enable mediation process to progress smoothly, it would be expected that the Trial Court does not proceed against either of the parties in both these matters.
