By the present Petition, the Petitioner has sought the following substantive relief in terms of prayer clause (b), which reads as under:- "b) That a writ of mandamus and /or any other appropriate writ, order, direction be issued to quash the F.I.R. No.0598 of 2025 registered by Kandivali Police Station u/s. 316(2), 318(4) and 3(5) of Bharatiya Nyaya Sanhita, read with sections 3 & 4 of Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 against the present Petitioner".

Mr. Vashisth Arora, learned Advocate for the Petitioner, on instructions from the Petitioner, seeks leave to withdraw the present Petition with liberty to file an application seeking discharge before the Sharada

13-WP-1553-2026.doc Trial Court at the appropriate stage. This request, made by Mr. Vashisth Arora, learned Advocate for the Petitioner, is not objected to by Mrs. Rajeshree Newton, learned APP for the State.

In view of the statement made by Mr. Vashisth Arora, learned Advocate for the Petitioner, leave is granted to withdraw the Petition, with liberty to file an application seeking discharge before the Trial Court at the appropriate stage. If an application seeking discharge is filed before the Trial Court at the appropriate stage, it shall be considered on its own merits and in accordance with the law. 4.

This Writ Petition No. 1553 of 2026 is disposed of as withdrawn. ( ASHWIN D. BHOBE, J.) Sharada
