P.C.:- 1) Petition No. 825 of 2025 is called out for hearing, at about 1:10 p.m..

1.1) At the outset, it be noted here that, Advocate Sameer Gauri appeared for the petitioners and 'directed' us 'to take up matter at Serial No. 48 also i.e. Writ Petition No.1596 of 2025, which is arising out of the same crime'. He further 'directed' us to issue notice to the Respondent No.2 as Petitions are being listed on board for the first time. 1/3

DDR 46 & 48.WP 825-25& ANR..doc 1.2) We informed him that, this is not a practice of this Court to blindly issue notices to the Respondents without seeing the merits of the case and unless prima facie case is made for issuance of notice. He therefore told this Court that, 'his senior is on his way and the Petitions may be kept back', to which we told him that, it is about 1:13 p.m. and his senior ought to have present before the Court to address this Court. 1.3) The afore-noted conduct of the Advocate Sameer Gauri is not appreciated by this Court.

2) At this stage, we were, in fact, inclined to dismiss the Petitions on this count alone. However, at the request of Advocate Sameer Gauri and on his solemn statement that, both the Petitioners will pay a cost of Rs.5000/- each, in each Petition, to the Bar Council of Maharashtra and Goa's Advocate Academy & Research Center, within a period of two weeks from the date of uploading of present Order on the official website of High Court of Bombay. The said statement is accepted as an undertaking given to this Court.

3) We therefore direct both the Petitioners to pay a cost of Rs.5,000/- each, in each Petition, to the Bar Council of Maharashtra and Goa's Advocate Academy & Research Center, within a period of two weeks from the date of uploading of present Judgment on the official website of High Court of Bombay.
