Heard learned Counsel for the parties.

By this petition, the petitioner seeks a direction to register an FIR on the basis of the petitioner's complaint. The said complaint dated 27th January, 2022 is at 'Exhibit-G' on page 50 of the petition. 1/3

Learned APP submits that the Police after conducting a preliminary inquiry, has come to the conclusion that the dispute pertains to the jurisdiction of the Municipal Corporation and accordingly, have 'filed' the said complaint. She further states that the said decision has also been communicated to the petitioner on 31st January, 2022. The said communication dated 31st January, 2022 is at page 51 of the petition.

In view of the aforesaid, nothing survives for further consideration in the petition.

Petition stands disposed of accordingly.

Needless to state, that we have not gone into the merits of the petitioner's complaint and the decision taken thereon and as such, all contentions of all parties are kept open. 2/3

Needless to also state, that it is open for the petitioner to take appropriate steps in accordance with law, in view of the letter (decision taken by the Police) dated 31st January, 2022. DR. NEELA GOKHALE, J.
