After it was revealed that the Petitioner is aware of the whereabouts of her son, viz., he is residing with his father and the minor daughter is residing with the Petitioner. The learned APP pointed out that even from the pleadings, more particularly paragraphs nos.7 and 8, it is evident that the Petitioner is aware that her son is with the father. There is a matrimonial discord, as set out in paragraph no.5. Proceedings for divorce and under the Domestic Violence Act, are pending.

The learned Advocate for the Petitioner submits, on instructions from the Petitioner, who is present in Court, that she has Gauri Gaekwad
908-WP-1662-2025.odt filed an application before the Family Court in the pending divorce proceedings seeking visitation rights and custody of the son. 3.
The learned Advocate for the Petitioner submits, on instructions that the Petitioner desires to withdraw this Petition. 4.
In view of the above, this Petition is disposed off as withdrawn, on instructions.

Needless to state, all contentions of the parties with regard to visitation rights as well as the custody of the son, are kept open to be considered by the Family Court and the withdrawal of this Petition would not be an impediment.
