This Petition is filed for quashing of the FIR lodged by the Respondent No.2 at Dindoshi Police Station vide C.R. Digitally signed by MANUSHREE NESARIKAR Date:

2025.04.28 11:34:45 +0530 MANUSHREE NESARIKAR No.890/2022, which is registered on 06/08/2022. The offences are u/s 354, 452, 323, 504 r/w 34 of the Indian Penal Nesarikar

2 / 3 Code. The incident took place on 04/08/2022 at about 06.45 to 07.15 p.m. in front of the house of the first informant. She was abused by the Petitioner No.3 Sumitra. The co-Petitioner Pravin also caught her hand, pushed her and co-Petitioner Ashwin also did the same thing and caught hold her Saree and tried to outrage her modesty. That is why the FIR was lodged. The police have investigated the offence and filed the charge-sheet. There are statements supporting the allegations in the FIR. 3.

During the pendency of this Petition, both the parties have settled the dispute. There is another Writ Petition No.1728 of 2024,. Both the parties have agreed to settle the dispute in both these Petitions. The Respondent No.2 is present. She has filed an affidavit whereby she has given her consent for quashing of the FIR. She has admitted the contents of the affidavit. Both are neighbours. It is in the best interest to quash the proceedings.

The dispute is personal in nature. Therefore, we are inclined to quash the proceedings. In this view, following order

Hence, the following order :

O R D E R

(i) The FIR registered vide C.R. No.890/2022 with Dindoshi Police Station and the further proceedings arising out of the said FIR, are quashed and set aside.

(ii) The Petition is disposed of.
