By this Petition, the petitioner is seeking expedite the trial of the Sessions Case No. 422 of 2019 pending before the learned District and Additional Sessions Judge, Panvel.

It is contention of learned counsel for the petitioner that this Court (Coram:Sarang V. Kotwal, J.) by order dated 24.08.2023 has directed to expedite the trial but till date there is no progress in the trial and only 3 witnesses have been examined out of 27 witnesses. Hence requested to expedite the trial by making it time bound.

Learned APP submits that this Court has already expedited the trial, hence it is not necessary to expedite it again and requested to dismiss the petition.

I have heard both the learned counsel. This Court had expedited the trial, in spite of that there is no progress in the trial. The petitioner stays at Virar whereas trial is going on at Panvel. The petitioner is attending every date of the trial Court. She is senior citizen and she find it difficult to attend each and every date of the trial. She is mother of the first informant. It appears from the record that accused are not appearing regularly before the trial Court. Considering this fact, I pass following order.
ORDER
i.
The Writ Petition is allowed.
ii.
The Trial Court shall dispose of Sessions Case No. 422 of 2019 as early as possible preferably within one year. 5.
Writ Petition is disposed of.
