Heard Mr. Sanjeev Sawant, learned Advocate for the Petitioner. He tenders copy of the order dated 24th October, 2024 passed by this Court in Criminal Writ Petition No. 3162 of 2024 which was filed by Akash Dilip Shelar and Another questioning the impugned FIR (FIR bearing No. 0205 of 2024) dated 4th May, 2024 registered with Nashik Talwalkar
28.WP1740.2025.doc Gramin Police Station, Nashik. He submits that the Investigation Officer had dropped the Accused No. 2(Rohan Vilas Shelar) from the said FIR. He submits that pursuant to recording of the said statement on 24th October, 2024, the prosecution has implicated the Petitioner herein as an accused by recording supplementary statement dated 8th November, 2024. He submits that the said act of the prosecution as also of the informant/victim is an abuse of the process of law. 3.
Mr. Sukanta Karmakar, learned APP after having argued the matter for some time, requests for time till 8th January, 2026 for taking instructions from the Investigating Officer and making further submissions.
