By the present Petition filed under Article 226 r/w. Article 14 & 21 of the Constitution of India and Section 482 of the Code of Criminal Procedure, 1973 read with Section 528 of the Bharatiya Nagrik Suraksha Sanhita, 2023, the Petitioner has

sought for the following substantive relief : "B.

By issue of Writ of Mandamus and/or any Writ of directions and/or any appropriate Writ and/ or Order in the nature of Writ by exercising its inherent and extra ordinary powers delegated Under Article 226 R/w. Section 14 and 21 of the Constitution of India R/w. Section 482 of the Criminal Procedure Code (S.528 of Bhartiya Suraksha Sanhita, 2023) to quash and set aside F.I.R No.205 of 2024 registered by MIDC Police Station, Taluka Sinnar, District Nashik for the offences punishable U/s. 354, 323, 504, 506 R/w 34 of Indian penal code at the instance of Smt. Madhuri Ravindra Kolpe the Respondent No.2 on 04/05/2024, against the Petitioner abovenamed along with Charge Sheet filed in RCC No. 475 of 2024 pending before Ld. JMFC, Sinnar, Dist. Nashik on such terms and conditions as this Hon'ble Court may deem fit and proper."

Mr. Sanjeev Sawant, learned Advocate for the Petitioner on instructions from the Petitioner craves leave to withdraw the present Petition with liberty to file an application seeking discharge before the Trial Court at the appropriate stage. 4.

Mr. Sukanta Karmakar, learned APP for the State does not object to the request made by Mr. Sanjeev Sawant, learned Advocate for the Petitioner.

In view of the above, leave is granted to the Petitioner to withdraw the present Petition with liberty as prayed. If any such

application is filed by the Petitioner before the Trial Court, the same be considered on its own merits and in accordance with law. 6.

Writ Petition No. 1740 of 2025 is disposed of with the liberty as above.
