The petitioner, who is the original complainant in C.C. No.PW/4700983/2024, presently pending before the Court of Metropolitan Magistrate, 19th Court, Esplanade, Mumbai, has approached this Court seeking directions for the expeditious hearing and disposal of the discharge application filed by respondent No.2 / original accused in the said proceedings. 3.

The learned Counsel submits that the FIR in the present case was registered in the year 2010, and the charge sheet came to be filed in 2012. The accused / respondent No.2 thereafter filed an application for discharge in year 2016. However, __________________________________________________ 9 April 2025

Mamta Kale 56-wp-1801-2025.docx despite the considerable passage of time, the said application has not yet been decided by the trial Court. It is submitted that due to the prolonged pendency of the discharge application, further progress in the trial has been effectively stalled. 4.

In view of the above, the learned Counsel seeks a limited relief directing the learned trial Court to take up the discharge application for hearing and decide the same expeditiously. 5.

Considering that the application has remained pending since 2016, the learned trial Court is requested to hear the discharge application and decide it on its own merits and in accordance with the law expeditiously.

The petition stands disposed of accordingly.
