We have heard learned Advocate for the Petitioner and the learned APP for the Respondents State.

The Petitioner has put forth prayer Clauses (b) and (c), as under :- "b) Direct the Respondents to delete/remove the name of Petitioner (Rizwan Ibrahim Dalal) from the list/record, if any, maintained by the Respondents regarding involvement of the Petitioner with the Students' Islamic Movement of India and not to harass the Petitioner and his family members on the Anand 1/3
ground of alleged involvement of the Petitioner with the Students' Islamic Movement of India;
c) Direct the Respondent No. 4 to decide/clear the Application ID Pune10241001697 (Exhibit-H) submitted by the Petitioner and issue Police Clearance Certificate to the Petitioner."

We have perused the communication dated 3rd June, 2016 issued by the Public Information Officer/Assistant Police Commissioner, Pune City addressed to the present Petitioner informing him that there is no case pending against him and there is no record as to why his name is included in a list of members affiliated to the Students' Islamic Movement of India (SIMI). We have also perused a recent communication by the Senior Police Inspector-cumInformation Officer, Crime Branch, Pune City dated 8th February, 2025 addressed to the Petitioner, informing him that there is no offence registered against him and there is no record with the modus operandi bureau about any offence committed by the Petitioner.

The learned APP has taken instructions and submits that prayer Clause (b) can be allowed, keeping in view that prayer Clause (c) has already been satisfied.

In view of the above, this Petition is allowed in terms of prayer Clause (b).
