It is the case of the Petitioner that, alleged contraband of Mephedrone (MD) weighing 65.5 grams, was planted on his person by the concerned Police Officer. Though he was taken into custody within the jurisdiction of Amboli Police Station, Andheri he has been shown as arrested near Bada Kabrastan, situated within the jurisdiction of Mumbra Police Station. A specific plea to that effect has been taken into the Petition.

As a serious allegation is levelled against the Police Officer of planting psychotropic substance on the person of Petitioner, we deem it appropriate to direct the Joint Commissioner of Police (Crime), Thane 1/2

SKN 3-wp 1980-25.doc Police Commissionerate to file a detailed reply to the Petition. We direct the Joint Commissioner of Police, not delegate his powers to any subordinate officer while filing the said reply. We request the Joint Commissioner to peruse entire record of the present case, so also the CCTV footage from the spots from where the Petitioner was alleged to have been taken into custody and brought within the jurisdiction of Mumbra Police Station. In the event, for any reason whatsoever CCTV footage is not available, at any place, in that case the Joint Commissioner of Police is directed to record statements of concerned persons/ witnesses enroute from Amboli to Mumbra Police Station. 2.1 The said reply be filed within a period of three weeks from today. 3.
