This Petition was circulated on the ground mentioned in the praecipe dated 30th January, 2026. Same is taken on record and marked "X" for identification.

By the present Petition, the Petitioner has sought for the following substantive reliefs :

"(a) that this Hon'ble Court may be pleased to exercise its powers under Article 226 of the Constitution of India read with Section 528 of Bhartiya Nagrik Suraksha Talwalkar

502.WP2049.2025.doc Sanhita, 2023 corresponding to section 482 of the Code of Criminal Procedure, 1973 and may be pleased to quash and set aside the chargesheet bearing C.R. No. 56 of 2025 registered with the Lonavala Police Station, DistPune for offence punishable under section 316(2), 318(4), 69 r/w 3(5) of Bhartiya Nyay Sanhita, 2023 and under Section 66(E) of Information Technology Act, 2000."

Mr. Abhinav Tayade, Advocate for the Petitioner states that the charge-sheet has been filed. He therefore on instructions from the Petitioner craves leave to withdraw the present Petition with liberty to file composite Petition. Request made by learned Advocate for the Petitioner is not objected to by Mr. Kiran Shinde, learned APP for State.

In view of the above, leave granted to withdraw the Petition, with liberty as prayed.

Writ Petition No. 2049 of 2025 is disposed as withdrawn with the liberty as prayed. All contentions of the parties are kept open.
