Ms. Jondhale, learned Counsel appearing for the Petitioner states that as the surety has not been furnished as directed by Order dated 4th February 2022 passed by the learned Additional Sessions Judge, Sessions Court, Greater Mumbai in Bail Application No.224 of 2022 in terms of Clause No.2 of the operative order, the learned Additional Chief Judicial Magistrate, 37th Court, Esplanade, Mumbai issued non-bailable warrant and by the impugned Order dated 6th March 2024, rejected the Application bearing Exhibit-5 filed in C.C. No.234/PW/2022 to

cancel the non-bailable warrant against the Petitioner, who is Accused No.5.

Ms. Jondhale, learned Counsel states that as the Petitioner is resident of Delhi, he will require some time to furnish surety. She submits that within a period of one month, the Petitioner will furnish the surety in terms of Clause-2 of the said Order dated 4th February 2022 passed in Bail Application No.224 of 2022. To enable the Petitioner to furnish the surety within a period of one month, the non-bailable warrant issued against the Petitioner i.e. Accused No.5 in CC No. 234/PW/2022 shall remain stayed for a period of one month. In the event, the surety is furnished as aforesaid within the period of one month in terms of the said Order dated 4th February 2022, the non-bailable warrant issued against the Petitioner shall stand cancelled. However, if the Petitioner fails to furnish the surety in terms of Clause No.2 of said Order dated 4th February 2022 passed in Bail Application No.224 of 2022 then in that event, the said non-bailable warrant issued against the Petitioner i.e. Accused No.5 can be executed.

Accordingly, the Writ Petition is disposed of in above terms with no order as to costs.
