Leave to amend to correct the cause title and to add the prayer clause regarding quashing of the criminal case and stay of the criminal case is granted. Amendment to be carried out forthwith.

Heard Mr. Abhinandan Vagyani, learned counsel for the Petitioner and Ms. M.M. Deshmukh, learned APP for the Respondent No.1-State.

Learned counsel for the Petitioner invited our attention to the FIR and the supplementary statement of the Respondent No.2. He submitted that the record shows that the physical relations between the Petitioner and the Respondent No.2 were going on from October, 2022 upto July, 2024 and thereafter they were infact staying together to the knowledge of the husband and son of the first informant. The supplementary statement shows that the husband of the first informant had left the first informant at the house of the Petitioner. All this clearly shows that it was a consensual physical relationship.

Learned counsel for the Petitioner also relied on the WhatsApp messages exchanged between the parties. Those messages also support the case of the Petitioner that it was a consensual physical relationship.

Considering these submissions, it is necessary to hear the first informant. Learned counsel for the Petitioner has made out a case for grant of ad-interim relief. Hence, the following order:

i.

Issue notice to the Respondent No.2, returnable on 15.7.2025. Till then the trial Court shall not proceed against the Petitioner.

ii.

Stand over to 15.7.2025.
